Mental Impairment Review Tribunal

Membership of the Tribunal

Pursuant to section 171 of the Criminal Law (Mental Impairment) Act 2023 (the Act), the members of the Mental Impairment Review Tribunal (the Tribunal) consist of:

  • the President
  • deputy presidents
  • community members
  • psychiatrists
  • psychologists
  • a person who, under the Disability Services Act 1993 section 9 or 10, works for Disability Services
  • representatives from Corrective Services
  • representatives from Youth Justice Service.

Pursuant to section 158(2)-158(5) of the Act, the President must, to the extent practicable, include a community member in a particular meeting with specific knowledge in the following areas, if the matter relates to:

  • an Aboriginal supervised person: to include a community member who has knowledge and understanding of Aboriginal culture local to the State
  • a child: a psychiatrist or psychologist, who specialises in child and adolescent treatment
  • a supervised person who has a mental illness: a psychiatrist
  • a supervised person who has a disability: a member appointed or employed by Disability Services, or appointed by the minister upon the nomination of the Minister for Disability Services.

Pursuant to section 158(1) of the Act, when exercising its jurisdiction, the Tribunal must be constituted by:

  1. The president or deputy president, and
  2. at least two other members, as specified by the president.

Tribunal members routinely undergo professional development, education and training.
